Just Released From Ohio Right To Life: Pro-Life Free Speech Rights Upheld

Ohio Right to Life applauds a victory for the free speech rights of peaceful pro-life demonstrators

(Columbus) An Ohio city will not appeal a federal judge’s decision that it violated the First Amendment rights of pro-life advocates when police officers threatened them with arrest for engaging in pro-life speech.

The case involved a July 31, 2007 demonstration by Missionaries to the Preborn. Members of the pro-life group stood on a public sidewalk holding pro-life signs and flags, and some had pro-life literature to offer to pedestrians. The demonstrators stood 15 to 50 feet apart on both sides of a street. The Tiffin Chief of Police told the demonstrators that they needed a permit and had to leave or face arrest. The demonstrators left, but later learned that there was no ordinance requiring a permit, and that the order to leave was based on an “All Events Policy” issued by the Mayor.

The demonstrators subsequently filed a complaint in federal court. In an opinion issued December 31, U.S. District Judge Jack Zouhary of Toledo held the policy to be unconstitutionally overbroad and stated that: “This permit scheme grants the City virtually unchecked discretion to deny permits for content-based reasons. There are no objective standards by which the City is bound when considering to issue a permit.” He concluded that under the policy “virtually any activity can be deemed an ‘event’ and require a permit.

“This is a victory for pro-lifers and everyone who values the freedom of speech,” said Ohio Right to Life President Mike Gonidakis. “Government officials should not be able to choose whether to harass peaceful demonstrators based on whether they prefer their message,” Gonidakis said.

The case is Trewhella v. Findlay.

New Pro-Life Law affects Ohio Supreme Court Case

(Columbus, OH) Ohio's new "Protecting Pregnant Women from Coercion & Violence Act" goes into effect today. In addition to protecting pregnant women from violence and coerced abortions, the new law allows individuals to seek damages by offering proof against abortion facilities demonstrating a pattern of failing to report known or suspected child sexual abuse.

The Ohio Supreme Court has noted this new provision in the Roe v. Planned Parenthood Southwest Ohio Region case.

The new law, sponsored by former Rep. Michelle Schneider:

1) Requires abortion facilities to post a "No One Can Force You to Have an Abortion" poster;

2) Requires mandatory minimum prison sentences for assault and increases penalties for domestic violence if the offender knew the victim was pregnant;

3) Permits recovery of compensatory and exemplary damages in a civil action for failure to file required reports of known or suspected child abuse; and,

4) Provides mandatory prison sentences and payment of restitution to victims in cases of "human trafficking" for prostitution. Recently, the Ohio Supreme Court issued an order directing the parties in Roe v. Planned Parenthood Southwest Ohio Region to file briefs addressing whether the provisions of the new law apply to the case. The case was brought by Cincinnati-area parents whose minor daughter had an abortion at a Planned Parenthood facility without ther parents' knowledge after being sexually abused by her adult coach. The parents allege that Planned Parenthood failed to comply with the statute requiring reports of known or suspected child abuse as well as Ohio's parental consent statute.

"We are proud that Ohio has acted to protect women and children from coercion and abuse," said Mike Gonidakis, President of Ohio Right to Life. "Coerced abortion, violence against pregnant women, and child abuse have no place in a civilized society," Gonidakis said. "We are also pleased thatthe Ohio Supreme Court has noted the new law in the Roe v. Planned Parenthood case. Regardless of the decision whether the new law applies to an existing case, the Supreme Court's action should send a message to those who fail to report child abuse that the new law will be enforced and that their actions can result in liability," Gonidakis said.

Umbilical Cord Blood Bill Introduced In Ohio House

(Columbus, OH) On March 26, 2009, State Representative Todd Book introduced a bill to promote umbilical cord blood donation. H.B. 102 requires the Ohio Department of Health to provide information on umbilical cord blood banking and donation via its web site. The Department of Health would encourage health care professionals to provide the materials to pregnant women as well.

Is Notre Dame Still Catholic?

By inviting Barack Obama to deliver the commencement address and receive an honorary degree at Notre Dame, the Rev. John Jenkins has polarized the Catholic community nationwide -- and raised a question. What does it mean to be a Catholic university in post-Christian America?

Are there truths about faith and morality that are closed to debate at Notre Dame? Or is Notre Dame like London's Hyde Park, where all ideas and all advocates get a hearing?

To Catholics, abortion is the killing of an unborn child, a premeditated breach of God's Commandment "Thou Shalt Not Kill." The case is closed for all time. Any who participate in an abortion are excommunicated. Catholic politicians from Nancy Pelosi to Joe Biden who support a "woman's right to choose" have been denounced from pulpits and denied Communion.

Obama, however, is the most pro-abortion president ever. On his third day in office, by executive order, he repealed the Bush prohibition against using tax dollars to fund agencies abroad that perform abortions.

ORTL Responds to Columbus Dispatch Editorial on RU-486

On March 31, 2009, the Columbus Dispatch printed Ohio Right to Life's response to a Dispatch editorial that criticized Ohio’s law which requires that the abortion drug RU-486 only be provided in accordance with federal Food and Drug Administration guidelines. The editorial had focused on Planned Parenthood’s arguments that “off-label” use of the drug had proved safe.

On April 9, the 30-day comment period will end in which citizens can voicetheir concern of President Obama's rescission of the Health Provider Conscience Clause. This clause allows medical professionals and hospitals to choose not to provide services that are contrary to their conscience or missions, specifically abortions.

Opponents claim that the Health Provider Conscience Clause hurts medical services to women. On the contrary, conscience clauses have been in effect since the 1970's, for over 30 years. During that time, abortions and sterilizations have not been limited by conscience clauses. Abortion is big business. Last year, Planned Parenthood, the largest abortion provider in theUnited States, grossed over a billion dollars with the help of $356 million dollars of taxpayers' money. Mandatory abortion services are simply not needed. What will be the results if the Provider Conscience Clause is rescinded? Medical professionals will risk losing their jobs. Catholic hospitals across the country, the largest provider of hospital services in this nation, will close down. Who will take them over? The government?

The quality of healthcare IN EVERY SINGLE AREA OF HEALTH will be drastically and negatively affected, as religious discrimination and persecution becomes institutionalized in our healthcare system. So why now is the Obama administration attempting to rescind this clause? He wants to make good on his promise to Planned Parenthood to abolish all restrictions on abortion. But because he knows that any American who knows about it would be appalled at such an act, he has given the American people a 30-day window to give their opinion. The 30-day window ends on April 9th! This was not reported in the "news." Obama is counting on the extremists, who believe that abortion should have no restrictions, to call in favor of rescinding conscience rights so that Obama can state that he did what the majority of Americans wanted. Even though the majority of Americans have no idea this is happening. Our country was founded upon religious freedom and the rights of life, liberty,and the pursuit of happiness. To repeal this clause and force individuals as well as medical organizations to conduct acts against their religious beliefs is discrimination; to be forced to commit acts against their right to freedom is against the Declaration of Independence. There are sufficient providers of abortion. It is clearly not necessary to force health care providers to do abortion. DON'T LET A POLITICAL AGENDA DESTROY OUR HEALTHCARE SYSTEM.

Facing Tough Washington Climate, Abortion Foes Move Debate Online

Regarding online/video activism:

But some longtime analysts of abortion politics say the right's online campaign appears to be having an impact.

"Certainly, there's a preaching-to-the-choir effect, but I don't think you can discount the effect on society over time," said Alesha Doan, a political scientist at the University of Kansas who supports legalized abortion. "They've altered the parameters of the discourse."

Ms. Doan said ultrasound images circulating online have been especially helpful to abortion opponents, because they humanize the fetus. "I've seen a marked change in how people talk about abortion," especially young adults, Ms. Doan said. "It's much more favorable to the pro-life movement."

Welcome To Our New Blog!

I'd like to go to this blog format for our website, so that other people have access and are able to use it as an enhancement for traditional communication. What I mean by that is that this blog can be frequently updated and viewed whenever a right to life activist has time to devote to the cause. Think about how many less phone calls you'd have to make if our members stayed up to date with the activities of other members by simply checking out this blog?

The core, active members will have the direct ability to post new articles - or to post updates on their activities. They can even post requests for help with certain tasks. (Stuffing newsletters, suggesting articles for our newsletters) This website should be about the constant flow of information: Networking, explanations on recent right to life developments, explanations on the latest web-networking tools. We need to start moving toward that trend to get the word out with the younger generation because the internet is where they hang out.

A blog can change the way an organization is operated. It means streamlining communication time - cutting communications down to the most vital so that the organization is most effective at accomplishing tasks with ease.

Our members who are interested in learning more about this type of communication - please let me know and I can give a class at our next meeting on how to use blogger.
